R Religious Worker Visa

R visas are for foreign religious workers coming to the United States temporarily to work for nonprofit religious organizations in religious occupations or vocations. Duration: Up to 30 months initially, 5 years maximum total. Must be member of denomination for 2+ years.

Path to Permanent Residence

R visa holders can transition to EB-4 special immigrant religious worker permanent residence after meeting additional requirements. EB-4 Requirement: 2+ years full-time religious work. Can apply while in R status for permanent residence for worker and family.

R Visa Eligibility Requirements

Basic Requirements for R Visa Classification

  • Member of religious denomination for at least 2 years before application

Religious Organization Requirements

Requirements for Sponsoring Religious Organizations

  • Must be nonprofit organization in United States
  • Tax-exempt status under section 501(c)(3) of Internal Revenue Code
  • Primarily religious nature and purpose
  • Authorized to conduct religious activities in U.S.
  • Affiliated with religious denomination (for some workers)
  • Able to compensate religious worker adequately

501(c)(3) Requirement

The sponsoring organization must have valid 501(c)(3) tax-exempt status from the IRS. Churches are automatically considered tax-exempt, but must still demonstrate religious purpose.

Organizations should maintain current financial records showing ability to compensate the religious worker at a level consistent with others in similar positions.

Important Lifetime Limit

R status is limited to 5 years total in a lifetime. After reaching the maximum, you must remain outside the U.S. for at least 1 full year before being eligible for another R visa.
