Exceptional Ability Definition

"Exceptional ability" means a degree of expertise significantly above what is ordinarily encountered in the sciences, arts, or business. Must meet at least three of the following criteria:

Important Distinction

Exceptional Ability vs. Extraordinary Ability: EB-2 exceptional ability has a lower standard than EB-1A extraordinary ability. Exceptional ability is "significantly above ordinary" while extraordinary ability requires being at the "very top" of the field.

PERM Labor Certification Process

PERM Requirement

Most EB-2 cases require approved PERM labor certification before filing Form I-140:

  • DOL Certification: Department of Labor must certify no qualified U.S. workers available
